Judge Diane Wood of the U.S. Court of Appeals in Chicago is said to be on President Obama’s “short list” to replace retiring Justice David Souter.

We’ve already noted that our chief concern before the high court is religious liberty.

While we haven’t reviewed Judge Wood’s body of opinions comprehensively, we note an encouraging early indication in the fact that she wrote a vigorous dissenting opinion from her court’s ruling that condo associations could ban the posting of mezuzahs (and other religious items) from tenants’ doorways, and that the federal Fair Housing Act did not bar this as religious discrimination.

This case is pending before the full 7th Circuit and we have the support of the U.S. Department of Justice in seeking its reversal.

Should that not occur, we will pursue a legislative remedy.
