In mentioning the brief the OU joined, the majority opinion stated: “The contemporary American Jewish community continues to place the education of children in its faith and rites at the center of its communal efforts.”
The brief addresses whether the First Amendment’s religion clauses prevent civil courts from adjudicating employment-discrimination claims brought by an employee against religious employers, when the employee carried out important religious functions.
